Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and BUILD STACK SOLUTIONS LTD ("Fluentist", "we", "us") and govern your use of the Fluentist mobile application and the website at fluentist.app (together, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms.

2. Licence to use the app

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the app on devices you own or control, for your own personal, non-commercial learning. You may not copy, modify, distribute, sell, rent, reverse-engineer, or attempt to extract the source code or content of the Service, except to the extent that applicable law expressly permits.

3. Your account

Some features may require an account. You are responsible for keeping your account credentials secure and for activity under your account. Let us know promptly at support@fluentist.app if you suspect unauthorised use. You can delete your account at any time in the app (Profile → Account → Delete account).

4. Subscriptions & purchases

Fluentist offers free content and optional paid features, which may be sold as one-time purchases or as auto-renewing subscriptions.

• Billing through the stores. All purchases are processed by the Apple App Store or Google Play under their terms. Prices are shown in the app before you buy and may vary by region and over time.
• Auto-renewal. Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within 24 hours before the period ends.
• Managing & cancelling. You can manage or cancel a subscription in your store account settings (Apple: Settings → your name → Subscriptions; Google: Play Store → Payments & subscriptions). Cancelling stops future renewals; it does not retroactively refund the current period.
• Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Cancel before the trial ends to avoid being charged.
• Refunds. Refunds are handled by the app stores under their policies. Except where required by law, payments are non-refundable.

5. Acceptable use

You agree not to: use the Service unlawfully or in breach of these Terms; interfere with or disrupt the Service or its security; access it through unauthorised means or automated scraping; attempt to bypass usage limits, entitlement checks, or content protection; or infringe the rights of others. We may suspend or limit access to protect the Service or other users.

6. Intellectual property

The Service and its content — including software, text, images, audio, designs, logos, and the Fluentist name and mascot — are owned by us or our licensors and are protected by intellectual-property laws. These Terms grant you no ownership rights. If you send us feedback or suggestions, you grant us a non-exclusive, royalty-free, worldwide licence to use them to improve the Service, without obligation to you.

7. Third-party services

The Service relies on third parties such as Apple, Google, and Cloudflare. Your use of those services is subject to their terms, and we are not responsible for them. Apple and Google are not parties to these Terms and are not responsible for the Service; where you obtained the app from their store, that store's usage rules also apply.

8. Disclaimers

The Service is a learning aid provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, and we do not guarantee any particular learning outcome, level of language proficiency, or fluency.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. On termination, the licence in Section 2 ends; sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

11. Changes

We may update the Service and these Terms from time to time. For material changes to the Terms, we will update the "Last updated" date and provide reasonable notice. Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law & disputes

These Terms are governed by the laws of England and Wales, without regard to its conflict-of-laws rules, and the courts of England and Wales will have exclusive jurisdiction over disputes, unless mandatory local consumer law provides otherwise. Nothing here removes protections you have under the mandatory law of your country of residence.
